Welcome to the Retosh Partners App. The App enables beauty service providers ("Salons and Specialists") to register and offer beauty services through the platform. By registering or using the App, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and Privacy Policy.

Part I – Terms & Conditions

1. Registration and Eligibility

To register as a Service Provider, you must:

• Be qualified to provide beauty services.
• Provide accurate and complete registration information, including your name, business name, identification or commercial registration, contact information, business address or service area, and any additional documents requested by the App.
• Keep your information accurate and up to date.

The App is not intended for use by minors. Any account found to belong to a person under the minimum age will be suspended or terminated.

2. Service Provider Responsibilities

Service Providers are responsible for:

• Delivering services professionally and safely.
• Maintaining the quality of the services they provide.
• Using appropriate products and equipment.
• Honoring appointments and notifying clients of any delays or cancellations.
• Protecting customer information and maintaining confidentiality.

3. Pricing and Payments

• Service prices are determined in accordance with the agreement between the Service Provider and the App.
• The App may deduct an agreed commission from payments.
• Payments must be processed through the payment methods approved by the App.

4. Platform Role

The App acts solely as a technology platform connecting Service Providers with customers. The App does not directly provide beauty services.

The App may:

• Display Service Provider profiles and customer ratings.
• Facilitate appointment scheduling.
• Process payments.
• Promote Service Providers and promotional offers.

The App is not responsible for the quality or outcome of services performed by Service Providers.

5. Ratings and Promotions

Customers may submit ratings and reviews. Service Providers are expected to respond professionally and continuously improve service quality.

Service Providers may offer promotional discounts on their services. The App may play an active role in promoting the offers through its digital platforms and reserves the right to modify or discontinue promotional campaigns.

6. Suspension or Termination

The App reserves the right to suspend or terminate any account that violates these Terms, applicable laws, or platform policies.

7. Intellectual Property

The App may use images, videos, and other content uploaded by Service Providers for marketing and promotional purposes.

Service Providers may not use the App's trademarks, logos, or branding without prior written authorization.

8. Changes to these Terms

These Terms & Conditions may be updated periodically. Continued use of the App after updates constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.

Part II – Privacy Policy

1. Information We Collect

We may collect the following information:

• Personal identification and business information.
• Contact information.
• Appointment and payment information.
• Photos, videos, and service listings.
• Device IDs (For analytics and notification)
• Device and application usage information.
• Location information as described below.

A. Location Services (Only for Specialists)

To support our hybrid service model, including both in-store and mobile in-home appointments, the App uses Specialist’s precise location information to automatically match Service Providers with their Specialists and nearby customer requests and facilitate efficient service dispatching.

B. User Control

Location tracking is entirely controlled by the Service Provider (“Salons and Specialists”). By default, the App operates with location tracking disabled. Location collection begins only when the Specialists manually changes their booking availability status to “Online” within the App’s Dashboard. When the Specialists changes their availability status to “Offline”, background location tracking immediately stops. To prevent indefinite background tracking, the background location collection stops when the current time reaches the end of the Specialist’s working hours.

C. Background Location

While the Specialist’s booking availability is marked as “Online” the App may collect precise location information even when the App is closed, minimized, running in the background, or the device is locked. This functionality is necessary to:

• Match nearby customer requests.
• Re-assign the Specialists
• Dispatch urgent or time-sensitive appointments.
• Optimize routing and travel efficiency.
• Provide customers with accurate estimated arrival times.

Background location is collected only while the Specialist has chosen to remain available for work.

D. Location Permission

To receive automatic nearby job assignments, Specialist must grant the device permission allowing location access at all times (or the equivalent permission available on their operating system), and must allow precise (not approximate) location.

If location permission is limited (for example, to “While Using the App”) or set to approximate rather than precise, automatic nearby job matching will not function correctly. In such cases:

• The App will display an in-app explanation of why precise, always-on location is required for dispatch matching before requesting the permission.
• The Specialist’s availability may automatically be changed to “Offline,” and new nearby in-home appointments will not be assigned until the required permission is restored.
• The Specialists may continue to use all other features of the App (viewing past appointments, managing their profile, messaging customers, etc.) without granting location access and even get booked by in-store service appointments.

E. How We Use Location Data

Location information is used exclusively to:

• Identify nearby customer requests.
• Assign appointments efficiently.
• Support routing and dispatch operations.
• Provide customers with arrival updates for confirmed bookings.
• Re-assign the Specialists by the salon if the assigned specialist were unable to do the services.

Location information is not used for advertising, behavioral profiling, or marketing purposes.

F. Location Data Retention

The app will not retain the location data when the Specialist’s booking availability is set to “Offline”. Precise location data collected during an “Online” session is retained up-to 1 Specialist’s working day, after which it is permanently deleted or anonymized for aggregate operational reporting (e.g., average travel time or extra-mileage calculation). Location data is not retained indefinitely.

2. How We Use Your Information

Your information is used to:

• Create and manage your account.
• Verify your identity.
• Schedule appointments.
• Process payments.
• Provide customer support.
• Improve the App and user experience.
• Comply with applicable legal and regulatory obligations.
• Protect the security and integrity of the platform.

3. Information Sharing

We do not sell your business and personal information.

Information may be shared only:

• With payment service providers to process transactions.
• With mapping, routing, and navigation service providers solely to calculate routes, distances, and estimated arrival times.
• With analytics or crash-reporting providers to maintain and improve App performance. These providers do not receive precise location data linked to your identity beyond what is necessary for the stated purpose.
• With trusted service providers (eg., SMS provider) supporting the operation of the App.
• When required by applicable law or a competent authority.

4. Data Security

We implement appropriate administrative, organizational, and technical safeguards to protect business and personal information against unauthorized access, disclosure, alteration, or destruction.

Location information and other personal data are processed securely and are accessible only to authorized personnel responsible for platform operations and service delivery.

5. Your Privacy Rights

Subject to applicable laws, you may request to:

• Access your business and personal information.
• Correct inaccurate information.
• Delete your business and personal information where legally permitted.
• Withdraw consent where processing is based on consent.

Account deletion:

You may delete your Service Provider’s account data directly within the App via Settings > Profile > Delete Account, without needing to contact support. Deletion requests are processed within 5 working days, except for information we are required to retain for legal, tax, or safety-reporting purposes

To exercise any other rights above, contact us using the details in Section 7.

6. Updates to this Privacy Policy

This Privacy Policy may be updated periodically. Any changes will be published within the App and will become effective upon publication.

الشروط والأحكام وسياسة الخصوصية للصالونات والأخصائيات

مرحباً بكم

مرحباً بكم في تطبيق رتوش للشركاء. يتيح هذا التطبيق لمزودي خدمات التجميل ("الصالونات والأخصائيات") التسجيل وتقديم خدمات التجميل من خلال المنصة. ومن خلال التسجيل أو استخدام التطبيق فإنك تقر بأنك قرأت وفهمت ووافقت على هذه الشروط والأحكام وسياسة الخصوصية.

الجزء الأول – الشروط والأحكام

1. التسجيل والأهلية

للتسجيل كمزود خدمة يجب عليك:

• أن تكون مؤهلاً لتقديم خدمات التجميل.
• تقديم معلومات تسجيل دقيقة وكاملة، بما في ذلك اسمك، واسم نشاطك التجاري، والهوية أو السجل التجاري، ومعلومات التواصل، وعنوان النشاط التجاري أو منطقة تقديم الخدمة، وأي مستندات إضافية يطلبها التطبيق.
• الحفاظ على دقة معلوماتك وتحديثها باستمرار.

التطبيق غير مخصص للاستخدام من قبل القاصرين، وسيتم تعليق أو إنهاء أي حساب يعود لشخص دون السن النظامية.

2. مسؤوليات مزود الخدمة

• تقديم الخدمات باحترافية وبأمان.
• الحفاظ على جودة الخدمات المقدمة.
• استخدام المنتجات والمعدات المناسبة.
• الالتزام بالمواعيد وإخطار العملاء بأي تأخير أو إلغاء.
• حماية معلومات العملاء والحفاظ على سريتها.

3. الأسعار والمدفوعات

• تحدد أسعار الخدمات وفقاً للاتفاق بين مزود الخدمة والتطبيق.
• يجوز للتطبيق خصم عمولة متفق عليها من المدفوعات.
• يجب معالجة جميع المدفوعات عبر وسائل الدفع المعتمدة من التطبيق.

4. دور المنصة

يعمل التطبيق كمنصة تقنية تربط بين مزودي الخدمة والعملاء، ولا يقدم خدمات التجميل بشكل مباشر.

يجوز للتطبيق:

• عرض ملفات مزودي الخدمة وتقييمات العملاء.
• تسهيل تسجيل وجدولة المواعيد.
• معالجة المدفوعات.
• الترويج لمزودي الخدمة والعروض الترويجية.

ولا يتحمل التطبيق مسؤولية جودة أو نتائج الخدمات التي يقدمها مزودو الخدمة.

5. التقييمات والعروض الترويجية

يجوز للعملاء تقديم تقييمات ومراجعات، ويتوقع من مزودي الخدمة الرد باحترافية والعمل على تحسين جودة الخدمة بشكل مستمر.

يجوز لمزودي الخدمة تقديم خصومات ترويجية على خدماتهم، كما يجوز للتطبيق الترويج لهذه العروض عبر منصاته الرقمية، مع الاحتفاظ بحقه في تعديل أو إيقاف الحملات الترويجية.

6. التعليق أو الإنهاء

يحتفظ التطبيق بالحق في تعليق أو إنهاء أي حساب يخالف هذه الشروط أو الأنظمة المعمول بها أو سياسات المنصة.

7. الملكية الفكرية

• يجوز للتطبيق استخدام الصور ومقاطع الفيديو وغيرها من المحتوى الذي يرفعه مزودو الخدمة لأغراض التسويق والترويج.
• لا يجوز استخدام العلامات التجارية أو الشعارات أو الهوية البصرية الخاصة بالتطبيق دون موافقة كتابية مسبقة.

8. التغييرات على هذه الشروط

قد يتم تحديث هذه الشروط والأحكام بشكل دوري، ويعد استمرار استخدام التطبيق بعد نشر التعديلات موافقة على النسخة المحدثة.

9. القانون الحاكم

تخضع هذه الشروط لأنظمة وقوانين المملكة العربية السعودية.

الجزء الثاني – سياسة الخصوصية

1. المعلومات التي نجمعها

يجوز لنا جمع المعلومات التالية:

• معلومات الهوية الشخصية ومعلومات النشاط التجاري.
• معلومات التواصل.
• معلومات المواعيد والمدفوعات.
• الصور ومقاطع الفيديو وقوائم الخدمات.
• معرفات الجهاز (لأغراض التحليل والإشعارات).
• معلومات استخدام الجهاز والتطبيق.
• معلومات الموقع الجغرافي كما هو موضح أدناه.

أ. خدمات تحديد الموقع (للأخصائيات فقط)

لدعم نموذج الخدمة الهجين، والذي يشمل المواعيد داخل الصالون والخدمة المنزلية، يستخدم التطبيق الموقع الدقيق للأخصائية لمطابقة الطلبات القريبة وتوزيع المواعيد بكفاءة.

ب. تحكم المستخدم

يتم التحكم الكامل في تتبع الموقع بواسطة الأخصائية. افتراضياً يكون تتبع الموقع معطلاً، ولا يبدأ جمع بيانات الموقع إلا عند تغيير حالة التوفر إلى متصل. ويتوقف التتبع فور تغيير الحالة إلى غير متصل، كما يتوقف تلقائياً عند انتهاء ساعات العمل.

ج. تتبع الموقع في الخلفية

أثناء كون حالة الأخصائية متصل، قد يجمع التطبيق الموقع الدقيق حتى عند إغلاق التطبيق أو تشغيله في الخلفية أو عند قفل الجهاز.

ويستخدم ذلك من أجل:

• مطابقة طلبات العملاء القريبين.
• إعادة تعيين الأخصائيات.
• توزيع المواعيد العاجلة.
• تحسين مسارات التنقل.
• تزويد العملاء بوقت وصول تقديري.

يتم جمع بيانات الموقع فقط أثناء اختيار الأخصائية البقاء متاحة للعمل.

د. إذن الموقع

للحصول على الحجوزات القريبة تلقائياً، يجب منح التطبيق إذن الوصول إلى الموقع بشكل دائم مع تفعيل الموقع الدقيق.

في حال كان الإذن محدوداً:

• سيعرض التطبيق سبب الحاجة إلى الموقع الدقيق والدائم.
• قد يتم تغيير الحالة تلقائياً إلى "غير متصل".
• لن يتم تعيين حجوزات منزلية جديدة حتى يتم منح الإذن.
• يمكن الاستمرار في استخدام بقية ميزات التطبيق، بما في ذلك الحجوزات داخل الصالون.

هـ. كيفية استخدام بيانات الموقع

• تحديد طلبات العملاء القريبين.
• تعيين المواعيد بكفاءة.
• دعم عمليات التوجيه والتوزيع.
• تزويد العملاء بتحديثات الوصول.
• إعادة تعيين الأخصائيات عند الحاجة.

لا تستخدم بيانات الموقع للإعلانات أو التسويق أو التحليل السلوكي.

و. الاحتفاظ ببيانات الموقع

لا يتم الاحتفاظ ببيانات الموقع عندما تكون الحالة "غير متصل". ويتم الاحتفاظ ببيانات الموقع أثناء جلسة "متصل" لمدة لا تتجاوز يوم عمل واحد، ثم يتم حذفها نهائياً أو إخفاء هويتها لأغراض التقارير التشغيلية.

2. كيفية استخدامنا لمعلوماتك

• إنشاء الحساب وإدارته.
• التحقق من الهوية.
• جدولة المواعيد.
• معالجة المدفوعات.
• تقديم الدعم الفني.
• تحسين التطبيق وتجربة المستخدم.
• الامتثال للمتطلبات القانونية.
• حماية أمن المنصة.

3. مشاركة المعلومات

نحن لا نبيع معلوماتك التجارية أو الشخصية.

ويجوز مشاركة المعلومات فقط مع:

• مزودي خدمات الدفع.
• مزودي خدمات الخرائط والملاحة.
• مزودي خدمات التحليلات والإبلاغ عن الأعطال.
• مزودي الخدمات الموثوقين مثل مزودي الرسائل النصية.
• الجهات المختصة إذا تطلب النظام ذلك.

4. أمن البيانات

نطبق إجراءات إدارية وتنظيمية وتقنية مناسبة لحماية بياناتك من الوصول غير المصرح به أو التعديل أو الإفصاح أو الإتلاف.

تتم معالجة بيانات الموقع والبيانات الشخصية الأخرى بشكل آمن ولا يمكن الوصول إليها إلا من قبل الموظفين المخولين.

5. حقوق الخصوصية الخاصة بك

يجوز لك طلب:

• الاطلاع على بياناتك.
• تصحيح البيانات غير الدقيقة.
• حذف بياناتك حيث يسمح النظام.
• سحب الموافقة إذا كانت المعالجة تعتمد عليها.

حذف الحساب

يمكنك حذف حسابك مباشرة من داخل التطبيق عبر: الإعدادات ← الملف الشخصي ← حذف الحساب. تتم معالجة طلب الحذف خلال 5 أيام عمل، باستثناء البيانات التي يجب الاحتفاظ بها لأسباب قانونية أو ضريبية أو أمنية.

6. تحديثات سياسة الخصوصية

قد يتم تحديث سياسة الخصوصية بشكل دوري، وتصبح أي تحديثات سارية بمجرد نشرها داخل التطبيق.
